What Is Qualified Individual (GLBA)?

DEFINITION

A Qualified Individual is the person the GLBA Safeguards Rule requires each covered financial institution to designate to oversee, implement, and enforce its information security program. The role may be filled by an employee, an affiliate, or an outsourced service provider, but the institution retains full responsibility for Safeguards Rule compliance regardless of who holds the title.

The Qualified Individual is the accountability anchor of the GLBA Safeguards Rule. The rule does not prescribe credentials or a title. It requires that one identified person have the qualifications, in proportion to the institution's size and complexity, to oversee the information security program. The role's defining duty is the written report to the board of directors or equivalent governing body, delivered at least annually, covering the program's status, risk assessment results, testing outcomes, security events, and recommended changes.

Every institution covered by the FTC's Safeguards Rule must make this designation, including auto dealers, mortgage brokers, lenders, and fintechs that may have no security staff at all. That is why the rule expressly permits outsourcing the role to a service provider or affiliate. Outsourcing comes with two conditions: the institution must designate a senior member of its own personnel to direct and oversee the provider, and the institution retains complete responsibility for compliance. The obligation never transfers.

The practical implication for mid-market firms is that a fractional or outsourced Qualified Individual is a legitimate path, but only when it comes with a real program behind it.
